Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Trivarent ("the Application"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Application.

2. License Grant

Gain Publications grants you a limited, non-exclusive, non-transferable license to install and use Trivarent on devices you own or control, subject to these Terms.

Free Tier: You may join sessions hosted by others at no cost.

Licensed Tier: Hosting sessions, accessing advanced features, and use in commercial or enterprise environments requires a valid license purchased through the Microsoft Store or directly from Gain Publications.

3. Prohibited Uses

You may not use Trivarent to:

  • Access, control, or monitor any device without the explicit consent of its owner
  • Transmit malicious code, malware, or any harmful content
  • Violate any applicable local, state, national, or international law
  • Infringe upon the intellectual property rights of any party
  • Harass, stalk, or harm any individual
  • Circumvent, reverse engineer, or attempt to extract source code from the Application
  • Resell, sublicense, or redistribute the Application without written permission

4. User Responsibility

You are solely responsible for all activity that occurs through your use of Trivarent. You must ensure that all session participants have consented to the connection and any actions taken during the session, including remote control, file transfer, and screen viewing.

5. No Warranty

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GAIN PUBLICATIONS DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAIN PUBLICATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Indemnification

You agree to indemnify and hold harmless Gain Publications, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising out of your use of the Application or violation of these Terms.

8. Updates and Changes

Gain Publications reserves the right to modify or discontinue the Application at any time. We may update these Terms of Use at any time. Continued use of the Application after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions.
